Head Lice: Legal Liabilities and Regulations for Australian Schools

Educational Guide for Schools, Parents and Carers

  1. Legal and Regulatory Framework

Head lice (Pediculosis capitis) are a common public health concern, but not a serious disease.

Management is guided by State and Territory Health Department policies and Education Department regulations, not by Federal law. Schools have a duty of care to protect the health, wellbeing and learning environment of students.

Education Department requirements generally allow a child with head lice to remain at school for the rest of the day, but require exclusion until treatment has commenced (usually the following day). Parents are required to notify the school if their child has head lice.

    2.  School Responsibilities

  • Notify parents if a case of head lice is detected in the classroom.
  • Maintain confidentiality and avoid stigma.
  • Request that children begin treatment before returning the next day.
  • Provide information on low-cost treatments where appropriate.
  • Ensure supervision until collection, but do not apply treatments.

     3. Frequently Asked Questions (FAQ)

Q: Does my child have the right to stay at school with head lice?

A: If head lice are detected during the day, the child can remain until home time. However, they cannot return the next day until treatment has started.

Q: What is the procedure if a student is found to have head lice?

A: The parent/carer will be notified. A letter may also go to the whole class. The child can stay at school until the end of the school day but must not return the next day until treatment has begun.

Q: What if I can’t pick my child up from school early because I’m working?

A: Schools cannot insist on immediate collection unless the child is unwell. The child may remain in class or in sick bay until home time. Parents are advised to organise treatment at home or a head lice salon before returning to school the next day.

Q: Can the school organise treatment for my child?

A: No. Schools and staff are not permitted to apply treatments due to legal liability and medical consent concerns. Only parents or authorised guardians can do this.  However, if your child is in boarding college, on a school camp, a liability and medical consent form can be authorised by caregivers, where options are limited for treatment, being remote.

Q: What if lice keep coming back, even after treatment?

A: Reinfection is common. Schools may send reminders to the whole class. Parents should recheck every 2–3 days, use a fine-tooth comb, and repeat treatments according to instructions.
